Conditions of registration
1. Enrolment and settlement of the contract with Tasca Tours
1.1 By filling in and sending the registration form on our website, you express your intention to settle a binding contract with Tasca Tours. Your intention of settling the contract will remain valid for 7 days after your enrolment, during which you will receive the confirmation of enrolment and the invoice by email or by post.
1.2 The tourist contract is achieved after sending the written confirmation and the invoice by Tasca Tours. According to the Romanian laws, the moment of the contract settlement (35 art. The Romanian Trading Code) is when we receive your online registration form.
1.3 Demands concerning the change or supplement of the tourist services as shown on our internet site as well as of the trading conditions become part of the contract only after the written confirmation of the Tasca Tours company. Cooperation partners or tourist agencies are not authorized in this matter.
1.4 Tasca Tours assumes responsibility for the actuality and the correctness of the online information about the offer of services; any change or supplement of the services stipulated in the contract shall be communicated to our clients within 48 hours.
1.5 Please inform us in case you have not received the travel documents 10 days at the latest before your arrival. In this case, we shall send you the documents immediately, provided the price for the booked services be wholly paid. If you do not inform us beforehand and you cannot travel from this reason, you will have to pay penalties for canceling our services.
2. Payment
2.1 A deposit of
10% (250 euros maximum for each
participant) of the total amount of price is due within 7 days after having received our confirmation of enrolment and the
invoice. The invoice must be paid in full 21 days before arrival.
2.2 In case we cannot confirm your registration or if you do not wish to accept our side offer in case of any changes, already paid fees will be refunded.
2.3 In case payments are not made at the stipulated deadlines and we are obliged to send warnings for this reason, we have the right to charge a lump sum of 10 euros.
2.4 In case the advance payment is not effected within 30 days after having received the invoice, or the rest payment is not wholly made within 15 days before your arrival, we reserve our right to cancel the contract and to charge penalties as stipulated in chapter III, art. 2 of these conditions, except the case in which up to that time the tourist services show drawbacks which give you the right to cancel your travel.
2.5 All payments for our services shall be in Euro currency.
3. Course levels
In the unlikely event Tasca Tours won't be able to create a
group course due to the fact of not having enough students at the same
time/level, smaller group courses or single lessons for a reduced amount will
be provided instead:
20 group lessons = 10 private lessons.
4 Tourist’s cancellation
4.1 You may cancel your enrolment ,wholly or partly, at any
time prior to the commencement of your course. However, you will be charged
cancellation fees:
- Cancellation up to 30 days before course commencement: 15% of total fees
- Cancellation between 29 and 22 days before commencement: 20% of total fees
- Cancellation between 21 and 15 days before commencement:
30% of total fees
- Cancellation between 14 and 7 days before commencement: 55% of total fees
- Cancellation less than 6 days before commencement: 70% of
total fees
- Cancellation on the day of your previously settled
arrival: 90% of total fees
4.2 No refunds will be made in case an embassy refuses you the Romanian visa or in case you miss your flight, if your papers are not right or if the boarder police order you no allowance in the country.
4.3 Each client has the right and possibility to prove that Tasca Tours was caused less damage than the percentage of penalties stipulated in the contract in case of cancellation; in this case the damage will be calculated individually for each case.
4.4 In the case of cancellation, we ask our clients to send back the travel documents that had already been sent, otherwise we shall invoice the whole price for the initially ordered services.
5. Annulment by the tour operator
5.1 In the most unlikely case of trip annulment before the date of arrival, you will have the following options:
a)to accept another offer of equivalent or superior standard at the same price, as suggested by the tour operator
b)to accept an offer of inferior standard, suggested by Tasca Tours, with the immediate refunding of the price difference.
c) immediate refunding of paid fees
d)to ask the a compensation for the inobservance of the initial contract, except for the cases mentioned in chapter V, art.1.
5.3 In case a participant has not a proper behavior during his /her stay or does not respect the conditions stipulated in the contract, without taking into account our warning, Tasca Tours has the right to annul the contract immediately after our notification. In case of deviations from the general rules of common sense, breaking the interior rules, as well as improper manifestations against the national customs and traditions, a warning is not necessary before the annulment. The supplementary costs due to the annulment shall be paid by the tourist. The money saved from undone damages shall be refunded.
6. Replacement
6.1 You may at any time ask for your replacement with another person, with the obligation to inform Tasca Tours in writing at least 3 days before the course commencement. For your replacement you will be charged with operational expenses of 25 euros.
6.2 The organizer has the right to refuse the participation of your substitute if the latter does not meet the requirements mentioned in the contract or if his / her participation is against legal regulations or official demands.
7. Change of reservation
7.1 You may change your reservation once, 21 days before your arrival, according to the availability of services, for a fee of 20 euros. Repeated changes or those demanded less than 21 days before your arrival are considered cancellation and new reservation; in this case the regulations stipulated in chapter IV will be applied.
7.2 If a modified reservation is cancelled afterwards, the reference price for the calculation of penalties is that of the initial reservation, in case this one is higher than the price of the modified reservation.
7.3 Each client has the right and possibility to prove that Tasca Tours was caused less damage than the percentage of penalties stipulated in the contract in case of cancellation; in this case the damage will be calculated individually for each case.
8. Unused Services
In case you interrupt the trip before the settled date or ifyou do not use certain services, , for other reasons, or respectively you change a reservation during your stay, Tasca Tours will try to give you back the saved expenditures of the service suppliers.
9. Non-performance of services by the tour operator.
In case an important part of the services stipulated in the contract is not carried out or Tasca Tours realizes during the trip that these services cannot be accomplished, we are obliged to one of the following options:
a) to offer you corresponding alternatives at the same quality, quantity and price
b) to pay back the difference between the paid services and those actually carried out
c) to provide compensation for non- used services and supplementary costs for your return trip or to another optional place, in case we cannot offer any other corresponding alternatives or if you do not accept them for good reasons;
10. Complaints and Guarantee
10.1 In case you are not satisfied with our services, please turn to your tour guide or contact us immediately at the address mentioned in your welcome pack. Both the service provider und us will take actions to solve your complaint. In case you do not inform immediately, you will not be entitled to claim for reduction of price or compensation. In case the complaint is not solved or it is solved partially, you will make a written complaint at the tour operator’s headquarters within a month after the end of your trip. Within 10 days you will be announced about the compensation you are entitled to.
10.2 In case you decide to interrupt the trip as a result of major defects of services, you first have to notify the defect and set an equitable time limit. This obligation is not applicable if remedial action can not be taken, is being refused or a cancellation of the contract is justified by a special interest from your part.
10.3 Claims for reduction of price and compensation become time-barred in one year. In case negotiations about your claims are not yet closed between Tasca Tours and yourself, the statute of limitation is tolled until you or Tasca Tours denies the continuance of negotiations. The time period under the statute of limitation begins three months after the suspension ends.
11. Passport, visa, customs and health formalities
The tourist is responsible
for respecting the legal precautions necessary for the trip. The damage for not
respecting the legal precautions concerning health, passport or visa, are on
the tourist’s charge, except the cases for the lack of information or false
information from the tour operator. For the latest legal precautions concerning
passport, visa and customs, the foreign Romanian embassies or consulates can be
consulted. There may be changes of these precautions any time from the state
leading bodies. Tasca Tours shall do all the best to instruct the tourist about
these changes.
12. Limitation of responsibility
12.1 TascaTours shall not take responsibility for the agent services (e.g.
trips, rent-a-car services, sports activities etc) which are mentioned in the
description of our offer and in the confirmation, even if these are accompanied
by a tour guide.
12.2 As long as a damage was not caused on purpose or due to gross carelessness
by the tour operator, or when this was due to a service provider; the
responsibility of the tour operator for material damage is on the limit of
three times the value of the price. These maximum responsibility values are
valid for each tourist and trip.
13. Increase of prices
13.1.Tasca Tours must inform the tourist about the increase of prices
immediately and 21 days before your arrival at the latest. or
13.2.In case the prices published on the internet site and established in the
contract increase by more than 5%, the tourist may annul the contract without
payment of penalties; already paid fees will be refunded.
13.3. Within 5 days after receiving the notice of price increase (chapter 12,
art. 1) the tourist must inform Tasca Tours it written, the decision for:
a)annulment of the contract with no penalty payment
b)acceptance of the new contract conditions .
14. Assurances
14.1 The tourist is assured for reimbursement of the money paid to TascaTours
in case of insolvency or bankruptcy through the policy nr. 6605519/07.04.2008
through the assurance agency Allianz

14.2.Optionally,the tourist may conclude an assurance contract to cover the
transfer taxes or an assistance contract to cover the repatriation taxes
in case of accidents, illness or decease or an assurance contract for the
luggage. These assurance services are not offered by the tour operator.
15. Prohibition of assignment of claims
Any transfer of the tourist’s claims to the organizer is forbidden. The
interdiction of transfer refers to the total claims from the tourist contract
as well as the claims from forbidden actions and unjust enrichment.
16.Other terms / Jurisdiction
16.1 The inefficiency of some terms of the contract including these conditions
have no effect on the whole contract.
16.2 For the tourist’s rights towards Tasca Tours, the
Courts of Frankfurt / Main will have exclusive jurisdiction. German Laws
shall be applied.
16.3 In case of a commercial claim, the place of jurisdiction will tour
operator’s headquarters.
The present conditions have been established according to both the German and
Romanian law.
